Terms of Service
By creating a MyEcho account or using the service, you agree to these terms. Please read them carefully. The plain-language summaries in this document are part of the terms.
1. The Service
MyEcho ("we", "us", "our") provides a digital legacy vault that allows users ("you") to store messages, files, and instructions for delivery to designated recipients after death or incapacitation ("beneficiaries"). MyEcho is available on the web at myechoapp.org; Android and Windows apps are in development. We are incorporated and operate from the United States.
2. Eligibility
You must be at least 18 years old to use MyEcho. By using the service, you represent that you are 18 or older and that the information you provide is accurate.
3. Account Security
- You are responsible for keeping your password, Vault PIN, authenticator app and recovery codes secure, and for all activity under your account.
- Your Vault PIN never leaves your device and we cannot reset it. If you forget it, the encrypted contents of your vault cannot be recovered. Keep an encrypted export and your PIN somewhere safe.
- Tell us immediately at myechosupport@gmail.com if you suspect unauthorized access. You can sign out other sessions and remove trusted devices yourself from Settings → Security.
- Do not share your password or Vault PIN with anyone, including family members you intend as beneficiaries.
4. Acceptable Use
You may use MyEcho to store lawful personal content for legitimate estate planning purposes. You may not:
- Upload or store illegal content of any kind.
- Use the service to harass, threaten, or harm others.
- Attempt to circumvent the delivery trigger system to harm beneficiaries.
- Upload content that infringes on third-party intellectual property rights.
- Attempt to access other users' vaults or accounts.
- Use automated scripts or bots to interact with the service.
5. Echo+ Free Trial
- New accounts can start a free 7-day Echo+ trial. A payment card is required to start it. You are not charged during the trial. Legacy and Family plans do not include a free trial, and each account can start only one trial.
- When the trial ends, it continues as a paid monthly Echo+ plan at the price shown when you started it, and your card is charged, unless you cancel before the trial ends in Settings → Plan & storage. We email you a reminder before the trial ends. Cancelling during the trial costs nothing.
- When the trial ends, your vault is not deleted. You'll need a plan to keep adding memories and to keep deliveries active.
6. Plans, Storage and Prices
- MyEcho offers the Echo+, Legacy and Family plans. Each plan can be combined with a storage size from 100 GB to 10 TB, and paid plans can add optional storage add-ons (+500 GB, +1 TB or +5 TB), billed monthly or annually with the plan. Features for each plan are listed on the pricing page.
- The price you are charged is the price shown to you before checkout for the plan, storage size and billing option you chose. Prices are set by us and calculated on our servers.
- Storage is a limit, not a metered charge. We warn you as you approach it. When you reach it, new uploads pause until you free up space or choose a larger size. Subscriptions that started before configurable storage keep the storage and overage terms they signed up with.
- We may change prices for new purchases at any time. We will give you at least 30 days' notice by email before a price change applies to your existing subscription. Changing your plan or storage uses the prices current at the time of the change.
7. Billing, Renewals and Changes
- Payments are processed by Stripe. By paying, you also agree to Stripe's terms. We never see or store your full card details.
- Monthly and annual plans renew automatically at the end of each period until you cancel.
- Upgrades and changes to a subscription apply straight away, and Stripe prorates the difference on your next invoice. You can only move to a smaller storage size if your files fit in it — we never delete files to make a downgrade work.
- Failed payments: if a renewal payment fails, Stripe retries it and we email you. You keep access while the payment is retried. If it still can't be collected, the subscription ends and paid features stop, but your vault is not deleted.
- Refunds: we do not offer refunds for partial billing periods, except where required by law. We may make exceptions at our discretion.
8. Cancellation
You can cancel a subscription at any time from Settings → Plan & storage or the billing portal. Cancellation takes effect at the end of the period you've already paid for, and you keep full access until then. Cancelling never deletes your vault.
9. Daily Backup
- A daily backup is included with every paid plan at no extra charge. It is not part of the free trial. It keeps a daily second copy of your vault and uploaded files in a separate backup store.
- Deleted files and older snapshots stay recoverable for 30 days. When a file is deleted from your vault, its backup copy is permanently removed once those 30 days have passed.
- If your paid plan ends, existing backups are removed once their 30 days have passed. Backup space follows your total storage (plan plus any add-ons); if it is full, newer files may not be backed up until you choose a larger size or remove files, and we'll tell you if this happens.
- Backups reduce the risk of data loss but cannot guarantee against it. Keep your own encrypted exports of anything irreplaceable.
10. Beta Access
We may invite you to test MyEcho as a beta tester. Beta access is free, is given at our discretion, may end on a date we tell you or at any time, and may include features that change or are removed. When beta access ends, your account returns to whatever other access it has (such as a trial or plan). Your vault is never deleted because beta access ends.
11. Delivery of Vault Contents
MyEcho provides the mechanism to deliver your vault to beneficiaries, but makes no guarantee that delivery will occur under all circumstances. Delivery depends on:
- Your account being active and in good standing at the time of the trigger event.
- Beneficiary email addresses remaining valid and accessible.
- The trigger conditions you configured being met.
Deliveries are paused while an account is scheduled for deletion. We strongly recommend testing your delivery settings and keeping beneficiary information up to date. MyEcho is a digital tool and is not a substitute for a legal will or estate plan.
12. Data and Content
You retain ownership of all content you upload to MyEcho. By uploading content, you grant us a limited license to store, back up, process, and transmit it solely to provide the service, including delivering it to the recipients you choose. We do not claim any ownership rights over your vault contents. Our Privacy Policy explains how long we keep data.
13. Service Availability
We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance with or without advance notice. We are not liable for losses resulting from service downtime.
14. Deleting Your Account
You can delete your account at any time from Settings. When you do, you are signed out everywhere, subscriptions are set not to renew, and backups and deliveries pause. You can restore your account from the link we email you for 30 days. After that, your vault, files, backups and account are permanently erased and cannot be recovered. We keep limited payment records where the law requires it.
15. Suspension and Termination
We may suspend or terminate accounts that violate these terms, with notice where appropriate. If we discontinue the service entirely, we will give at least 90 days' notice and a way to export your data.
16. Disclaimers and Limitation of Liability
MyEcho is provided "as is" without warranties of any kind. To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages, including loss of data or failure of vault delivery. Our total liability to you shall not exceed the amounts you paid us in the 12 months prior to the claim.
17. Governing Law
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Disputes shall be resolved by binding arbitration under AAA rules, except that either party may seek injunctive relief in court.
18. Changes to These Terms
We may update these terms. We will notify you by email at least 14 days before material changes take effect. Continued use of the service after changes constitutes acceptance of the new terms.
